This Privacy Policy explains how Cloudasys, LLC ("we," "our," or "us") collects, uses, discloses, and protects personal information when you create an account on and use the Cloud Command platform (the "Platform") at cloudasys.com and related services. It covers the Platform itself; our public marketing website has its own separate privacy policy.

1. Who This Applies To

This policy applies to account owners, users, and administrators who access Cloud Command, and to the individuals whose information they provide to us in the course of using the Platform. If you use Cloud Command through a partner (a managed service provider that resells the Platform under its own brand), that partner is responsible for its own privacy practices and its own version of this policy applies to you.

2. Information We Collect

Account & contact information

Name, company name, business address, email address, phone number(s) including any mobile number you provide for text alerts, job title, and the login credentials you set. Passwords are stored only as salted hashes; we never store them in readable form.

Billing information

Billing contact details, plan and subscription details, invoices, and payment records. Card payments are handled by our third-party payment processor; we do not store full card numbers on our systems.

Service & usage data

Configuration and metadata for the infrastructure you provision (such as virtual machines, storage, and networks), resource usage and performance metrics, activity and audit logs, support tickets and related correspondence, and technical data such as IP address, browser, and device information used to secure and operate the Platform. We do not access the contents of your virtual machines or stored data except as needed to provide or support the Services, or as required by law.

Communications

Records of your interactions with us — support requests, emails, and, where you have opted in, SMS text messages.

3. How We Use Information

  • Provide, operate, secure, and maintain the Platform and your account.
  • Process billing, subscriptions, and payments.
  • Provide customer support and respond to your requests.
  • Send service, account, security, and billing notifications (including SMS alerts you have opted into).
  • Monitor, troubleshoot, and improve reliability, performance, and security.
  • Detect, prevent, and investigate fraud, abuse, and violations of our Terms.
  • Comply with legal obligations and enforce our agreements.

We do not use your account information or the contents of your infrastructure for advertising, and we do not sell your personal information.

4. SMS / Text Messaging

If you opt in, we use the mobile number on your profile to send the categories of account, service, and security text alerts you selected. Message frequency varies. Message and data rates may apply. You can opt out at any time by replying STOP, or get help by replying HELP. Mobile information collected for text alerts is used solely to deliver those alerts and is never sold, rented, or shared with third parties or affiliates for their marketing or promotional purposes. Aggregators and wireless carriers may process message delivery on our behalf. For full details see our Messaging (SMS) Terms.

5. How We Share Information

We do not sell personal information. We share it only as needed to run the Platform:

  • Service providers (sub-processors) that process data on our behalf under contract — for example payment processing, cloud and hypervisor infrastructure, email delivery, and SMS delivery. They may use your information only to provide services to us.
  • At your direction, or with other users on your account, as part of operating your services.
  • Legal and safety: when required by law, subpoena, or court order, or to protect the rights, property, or safety of our users, the public, or us.
  • Business transfers: in connection with a merger, acquisition, financing, or sale of assets, subject to this policy.

Business customers who require a Data Processing Addendum (DPA) may request one from us.

6. Data Retention

We retain personal information for as long as your account is active and as needed to provide the Services, then for the period required to meet our legal, tax, accounting, and security obligations, after which it is deleted or anonymized. You can request deletion of your personal information as described below; some records may be retained where the law requires.

7. Data Security

  • Encryption of data in transit.
  • Role-based access controls limiting who can access personal data.
  • Audit logging of significant account and administrative actions.
  • Hosting in United States datacenters within facilities that maintain their own independent security attestations.
  • Ongoing monitoring, patching, and security review.

No method of storage or transmission is completely secure; while we work hard to protect your information, we cannot guarantee absolute security.

8. Your Rights & Choices

Depending on your location, you may have the right to:

  • Access the personal data we hold about you.
  • Correct inaccurate or incomplete data.
  • Delete your personal data.
  • Receive a copy of your data in a portable format.
  • Opt out of, or back into, SMS alerts at any time from your profile or by replying STOP/START.

To exercise these rights, contact us at support@cloudasys.com. California residents have additional rights under the CCPA, including the right to know what personal information is collected and to request its deletion; we do not sell personal information as defined by the CCPA. If you are in a region covered by the GDPR or similar laws, you may also have the right to object to or restrict certain processing and to lodge a complaint with your supervisory authority.

9. International Data Transfers

We operate from and store data in the United States. If you access the Platform from outside the United States, you understand your information will be processed in the United States, where data-protection laws may differ from those in your country.

10. Children's Privacy

The Platform is intended for business use and is not directed to individuals under 16. We do not knowingly collect personal information from children. If you believe a child has provided us information, contact us and we will delete it.

11. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be posted here with a new "Last updated" date, and where appropriate we will notify you. Continued use of the Platform after changes take effect constitutes acceptance of the updated policy.
